Diagnostic
Audit Risk Check
A high-level diagnostic of current files to identify gaps in Subpart B prohibitions or driver qualification files before the FMCSA arrives.
Compliance-as-a-Service
Specialized compliance architecture for small interstate motor carriers (1-10 trucks). We bridge the gap between lean operational execution and the technical rigors of federal oversight, keeping your operating authority audit-ready from day one.
Leadership Profile & Strategic Vision
In the contemporary freight environment, the margin for regulatory error has virtually evaporated. A single administrative oversight is a systemic risk that can revoke your operating authority.
First-hand knowledge of the operational pressures and roadside realities faced by commercial drivers.
Deep insight into the administrative infrastructure required to sustain compliance at scale.
A commitment to precision, mission-critical reliability, and disciplined execution of complex regulations.
Certified to train and develop the next generation of commercial drivers to the highest safety and competency standards.
Founder & CEO Alexander P. Sheldon applies military-grade discipline and corporate-level operational knowledge to the Fractional Safety Manager model, empowering small interstate motor carriers to navigate the FMCSA landscape.
The New Entrant Framework
The first 18 months of a motor carrier's existence are a high-stakes probationary period. Proactive management is a business-preservation requirement; waiting for an audit notice is almost universally doomed to failure.
Heightened monitoring of all roadside inspection data and safety performance.
A mandatory technical review within the first 12 months. Failure results in immediate suspension of registration.
Per § 382.701(c), the FMCSA notifies employers if new information appears in the Clearinghouse within 30 days of a query.
Under § 385.321, the FMCSA identifies 16 "Automatic-Failure" violations. A single occurrence triggers a failing audit. These lethality factors are why technical drug & alcohol compliance is the highest priority for a New Entrant.
Utilizing a driver with "Actual Knowledge" of drug or alcohol use or failing to implement a required testing program.
Utilizing drivers without a valid CDL or an active Medical Examiner’s Certificate.
Failing to maintain required levels of public liability insurance.
Operating an "Out-of-Service" vehicle before required repairs are completed.
Regulatory Deep-Dive
A "Zero-Error" drug and alcohol program is the primary defense for a carrier's operating authority. Small carriers often fail by testing when not legally authorized, or failing to test when mandated.
| Testing Type | Trigger / Strategic Requirement | Mandatory Consequence |
|---|---|---|
| Pre-employment | Prior to the first performance of a safety-sensitive function. | Verified negative result required before any duty occurs. |
| Random | Scientifically valid selection throughout the year. | Drivers must proceed to the test site immediately upon notification. |
| Post-accident (Fatality) | Any occurrence involving the loss of human life. | Alcohol test within 2-8 hours; Drug test within 32 hours. |
| Post-accident (Non-Fatal) | Citation issued AND medical treatment away from scene or vehicle tow-away. | No citation issued = No DOT test permitted. |
| Reasonable Suspicion | Specific, contemporaneous, articulable observations by a trained supervisor. | Employer must remove driver; "Direct Observation" limited to the act of use. |
For owner-operators or single-driver fleets, § 382.103(b) mandates joining a Consortium to ensure a random testing pool of at least two covered employees.
Carriers must conduct Full Queries (requiring digital consent) for all new hires and Limited Queries annually for current drivers.
Per § 382.703(a), written or electronic consent for these queries must be retained for three years. APS Strategies and Solutions simplifies these complexities through our managed service suite.

Form F-3
Specifically designed to meet the 3-year retention requirement for Clearinghouse query consents and results (§ 382.703(a)).
Forms F-4 / F-5
Organizes prior employer inquiries and verification of medical explanations for "shy bladder" or "shy lung" situations, creating a bulletproof audit trail.
